Dear Board Members:

You may have read or heard that on July 11, 2011 the Pasadena City Council passed Ordinance No. 7208 amending the tobacco use prevention ordinance, Chapter 8.78 of the Pasadena Municipal Code, to reduce drifting tobacco smoke in multi-unit housing. The ordinance bans smoking in all common areas effective January 1, 2012.

We have been in contact with the City of Pasadena's non smoking Program Coordinator, Statice Wilmore, and she has advised us that at this time the City is still in the process of drafting letters to homeowner associations and property managers that will provide more information. The City is planning an ad campaign to inform the residents. What they require now is notification of the ordinance and the posting of signs. Sign templates are being prepared that will be available on their website in the near future. The City will also be providing technical workshops to the public at a later date. Ms. Wilmore said that they anticipate it will take 6 to 9 months to fully implement the ordinance.

The ordinance also includes banning smoking inside multi-unit housing effective January 1, 2013.

Homeowner associations and managers are not required to enforce the smoking ban. The ordinance is to be enforced by the City Health Department.
